North Yorkshire Council is set to discuss new enforcement tools aimed at tackling illegal tobacco and vape sales, providing innovative solutions to protect local consumers.

On Tuesday 27th October, the council’s executive will consider adopting a revised policy for the county's trading standards team, reflecting changes in national legislation and addressing threats to residents and legitimate businesses.

The proposed framework introduces the use of fixed penalty notices for offences under the Tobacco and Vapes Act 2026, enhancing existing enforcement options such as prosecution for businesses selling tobacco or vape products to children.

The policy recognises the pioneering work of the National Trading Standards e-Crime Team, co-hosted with City of York Council, which targets misleading online platforms that can leave consumers out of pocket.

Statistics reveal the scale of the issue, with over 1.19 million illegal vapes seized in England during 2023 and 2024, and many unlawful sales made to children during test purchases.

Cllr Richard Foster, North Yorkshire Council's executive member responsible for trading standards, supports the proposed policy, highlighting the trading standards team's role in protecting residents and supporting honest businesses.

Foster stated, “This updated policy provides a transparent framework for enforcement, allowing effective responses to emerging challenges while ensuring a fair approach.”

The revised policy aligns with the council's broader enforcement strategy, aiming to keep people safe, healthy, and thriving within their communities.
