Great Yarmouth MP Rupert Lowe seeks High Court intervention in watchdog investigation

Independent MP Rupert Lowe, representing Great Yarmouth, has approached the High Court in pursuit of a temporary injunction to halt an investigation by the parliamentary watchdog following a complaint against him.

The investigation by the Independent Complaints and Grievance Scheme (ICGS) stems from a complaint made last July by an unidentified third party.

Lowe aims to challenge the ICGS decision and hopes to have it quashed.

A comprehensive hearing is scheduled for next month, but Lowe’s lawyers requested a temporary hold on the investigation during a court session in London on Tuesday.

The ICGS opposed this application, asserting that the court lacks jurisdiction and that granting the request would infringe upon parliamentary privilege.

Christopher Newman, representing Lowe, argued in written submissions that the ICGS processes were procedurally unfair and potentially biased, claiming these processes could threaten Lowe's political career.

Newman stated there is “troubling evidence of corruption of process unfairly affecting Mr Lowe,” indicating that information might have been leaked to Reform UK, which then initiated its own inquiry.

Newman also contended that the court is likely to determine parliamentary privilege does not prevent judicial review of the ICGS processes.

He said Lowe finds himself in a challenging position.

He is expected to answer questions about his conduct but has yet to receive responses from the ICGS regarding procedural inquiries.

Newman argued that an interim injunction would not cause harm to the ICGS.

Conversely, Sarah Hannett KC, representing the ICGS, maintained the position that Lowe, as a sitting MP, is answerable to the House of Commons and must adhere to established standards of conduct.

She highlighted the constitutional role of the court does not include oversight or interference with parliamentary investigations.

Ultimately, matters concerning the integrity of the complaint and the fairness of the investigation are designated to the bodies established by Parliament to handle such issues.

The ICGS is tasked with investigating MPs' inappropriate behavior complaints.

Revisions passed by MPs last June led to a permanent ICGS assurance board being established for oversight purposes.

Previously a Reform UK MP, Lowe was suspended by the party amid allegations of threatening then-party chairman Zia Yusuf, which he denied, with no charges brought by the Crown Prosecution Service.

Following his departure from Reform UK, Lowe initiated Restore Britain as a political movement.

Justice Chamberlain is expected to announce his decision on 24th February.
