Planning approved for vehicle fuelling station

A new vehicle fuelling station in the north of Carlisle has been allowed to proceed by planning officers at Cumberland Council.
The planning application was for land off Chandler Way, next to the Asda supermarket, and the development would include a Bio-CNG vehicle fuelling station comprising fuel dispenser islands, a plant compound, landscaping, a revised car parking area, new accesses and associated development.
According to the decision report the grounds for the application for a lawful development certificate were that works carried out on the site qualify as a lawful start on site.
It states that it was originally granted planning permission in September 2023 and the ‘certificate of lawfulness to certify the development has been lawfully commenced and therefore remains extant’.
The report adds: “The grounds for the application for a lawful development certificate are that works carried out on site qualify as material operations that constitute a lawful start on site as per the act refers to the digging of a trench which is to contain the foundation, or part of the foundation, of a building.”
According to the report the agent has confirmed that the works undertaken to date include: site mobilisation; site compound perimeter fencing installed; infiltration testing completed; site clearance commenced; and concrete base excavation commenced.
The final decision according to the report states: “The excavation works for the compressor foundations undertaken constitute material operations in accordance with the Town and Country Planning Act 1990.
“The supporting evidence demonstrates on the balance of probabilities that these works have been undertaken within the three-year time limit imposed on the planning permission approved under application 22/0726, and the pre-commencement conditions imposed on the permission have been satisfactorily discharged. Therefore, the works are considered to be lawful.”
