Operator faces 12-month navigation ban in Plymouth waters
A powerboat operator has been fined £1,205 and prohibited from using Plymouth waters for 12 months following a court ruling.
Plymouth Magistrates’ Court found the operator guilty of the unsafe use of a vessel, endangering passengers, themselves, and other water users near moorings and a public slipway in Plymouth.
The case, prosecuted by the Devon & Cornwall Marine Unit, marks the first use of the Merchant Shipping (Watercraft) Order 2023 in Devon & Cornwall.
The legislation aims to improve safety and address dangerous maritime practices.
Cattewater Harbour Commissioners, who provided evidence, expressed satisfaction with the court's decision.
"We are pleased with today's result, which demonstrates the flexibility and effectiveness of both newly established national legislation as well as existing local Directions and Byelaws in maintaining safety on our waterways," they said.
The operator was also given a Community Protection Notice Warning (CPNW), preventing the use of any waterways in Plymouth for 12 months.
During sentencing, the Judge emphasised the importance of understanding maritime regulations.
"Being naïve to the rules is not an excuse. If you own a boat, understanding your responsibilities comes with that ownership."
Cattewater Harbour Commissioners continue collaborating with local authorities and enforcement agencies to ensure safety in Plymouth waters.
