Clevedon businessman overwhelmed by legal costs as High Court upholds parking fees
Council welcomes court ruling, but Daniel Adams faced with financial strain
A Clevedon businessman is facing deep uncertainty over legal costs after the High Court dismissed his challenge to overturn North Somerset Council's parking charges in the town.
Daniel Adams, who owns Stationery House, initiated the legal proceedings after North Somerset Council introduced parking fees at three car parks following an erroneous public consultation process.
Despite representing himself and highlighting procedural breaches by the council, the High Court found these errors did not substantially affect the decision-making process.
Adams conveyed the gravity of his situation: “I’m struggling to sleep at night because I don’t know what kind of bill I’m going to face, which I’ve got to personally find the money for.”
He explained that the stress of the council demanding full payment for legal costs surpasses his earlier health battle with cancer and chemotherapy.
In discussing the council’s persistent demands, Adams said: "Every attempt I've made to mediate with them and try and reach some kind of agreement, they've just rejected everything. They want the full amount."
North Somerset Council responded positively to the court’s decision.
They stated: "North Somerset Council has always been confident in the process followed when introducing parking charges to Clevedon car parks and we welcome the Court’s decision."
The council plans to conduct a six-month review of the charges at Clevedon car parks using data from ticket sales to assess their impact on driver behaviour.
They affirmed: “As part of our Parking Management Strategy adopted in 2024, the introduction of parking charges allows for the delivery of better funded parking services, including increased maintenance of the car parks.”
This strategy aims to balance the council's finances while ensuring effective parking management.
Adams continues to face emotional and financial strain as he awaits the final amount for legal costs.
