Officer's use of force deemed excessive during arrest in Kings Lynn
A Norfolk Constabulary officer has been issued a final written warning for gross misconduct during the arrest of an 18-year-old in Kings Lynn.
In the early hours of 5th September 2023, officers responded to a call concerning an assault involving siblings.
They arrested the suspect in a bedroom, where one officer used PAVA spray thrice, with the panel finding the third usage excessive after the man was handcuffed.
The disciplinary panel asserted that this action was neither necessary nor reasonable.
Additionally, the man was further arrested for assaulting an emergency worker by spitting at the officer.
While in the police van, the man informed officers of his Tourette’s Syndrome, to which the officer responded indifferently.
Earlier, the officers had escorted the man home following a disturbance report, with no offences identified.
The disciplinary hearing concluded on 27th May, finding the officer guilty of breaching professional standards including use of force, courtesy, conduct, and responsibilities.
The officer, identified as PC Thomas Colgan, is now subject to a final written warning lasting two years.
IOPC Director, Emily Barry, emphasised the duty of officers to uphold respect, stating: “All officers should treat members of the public with respect and courtesy and PC Colgan’s conduct fell well short of the standards expected of police officers.”
The investigation commenced in April 2024 following a voluntary referral from Norfolk Constabulary.
It involved reviewing body worn video, witness statements, and relevant PAVA usage guidelines.
The investigation concluded in February 2025, resulting in a decision for gross misconduct proceedings.
