Chinese takeaway fined for misleading food hygiene claims
Court hears of menu errors despite warnings
A Chinese takeaway in Eccleston has been fined after misleading customers about its food hygiene rating.
Owners Feng Biao He and his son Kai Qiang He appeared at Preston Magistrates’ Court on 20th May 2026, where they admitted distributing menus falsely claiming a five-star rating.
An investigation by Lancashire County Council's Trading Standards officers was launched following complaints from the public, and despite receiving advice and warnings, the false claims continued.
Officers found numerous menu leaflets displaying the incorrect rating in January 2025, with more misleading menus appearing on later visits.
Although a later inspection improved the business's accurate rating to three stars, a November 2025 visit by Trading Standards revealed that menus still promoted the incorrect five-star rating.
Feng Biao received a £1,250 fine, totalling £3,740 in penalties, while Kai Qiang was fined £250, as part of £1,350 in costs.
Councillor Joshua Roberts stressed the importance of truthful food hygiene ratings, saying the case shows the council will act to protect the public and support business honesty.
The Food Hygiene Rating Scheme helps diners decide where to eat, with ratings from Five (very good) to Zero (urgent improvement required).
